InstantStudio Custom Endpoints Terms of Service & Privacy Policy

Introduction
Welcome to InstantStudio Custom Endpoints ("Service"), developed and hosted by InstantStudio ("we", "our") on behalf of our Creators ("Creator"). By accessing or using this Service, you ("User") agree to comply with and be bound by these Terms of Service and Privacy Policy.
Data Collection and Use
- We may collect personal information such as your email address for marketing purposes. You consent to receive occasional marketing communications from InstantStudio.
- Your personal data will never be sold to third parties.
- All collected data is securely stored on InstantStudio servers with industry-standard encryption and access controls.
- We apply data minimization principles, collecting only necessary data and limiting retention periods to reduce privacy risks.
- Generated image data is shared exclusively with the Creator who created the Custom Endpoint.
- The Creator determines how long image data is retained, but in no circumstances will image data be stored longer than 30 days. After this period, image data is permanently destroyed.
Use and Storage of Uploaded Images
- If you upload images of yourself “selfies”, or other personal images, you acknowledge and consent that these images will be processed by the Service to generate AI content.
- All Uploaded images are stored securely on InstantStudio servers and shared only with the Creator responsible for the Custom Endpoint you use.
- Selfies and related image data will be retained for no longer than 30 days, after which they are permanently deleted from all storage systems.
- We do not use your selfies or personal images for any purpose other than providing the Service, including marketing, profiling, or training AI models, without your explicit consent.
- You are responsible for ensuring that any selfies you upload do not violate any laws or third-party rights.
- We obtain your explicit consent before collecting, using, or sharing any personal data, and you may withdraw consent at any time.
User Responsibilities and Content Guidelines
- You must own or have rights to any images you upload. Do not upload images of anyone without their permission.
- You may not upload or generate content depicting violence, nudity, hate speech, terrorist propaganda, illegal activities or other harmful or disturbing material.
- The Service must not be used for any unlawful or harmful purposes.
- Due to the nature of AI-generated content, InstantStudio cannot guarantee the quality, accuracy or appropriateness of generated images. Users acknowledge that the Service may produce unintended artifacts, disturbing imagery or unexpected results. You use the Service at your own risk.
Intellectual Property Rights
- You retain full rights to the original images you upload. InstantStudio and the Creator do not claim ownership of your uploaded content.
- InstantStudio or the Creator may use generated images solely for the operation and delivery of the Service as defined by these terms.
Creator Disclosure
- InstantStudio provides this Service on behalf of our Creators. By using a Custom Endpoint, you acknowledge that image data generated or uploaded will be shared directly with the Creator responsible for that specific endpoint.
- InstantStudio is not responsible for how the Creator handles data once shared. We recommend reviewing the Creator’s own privacy policies.
Warranty Disclaimer
The Service is provided on an "as is" and "as available" basis. InstantStudio makes no warranties or representations of any kind, express or implied, regarding the reliability, suitability, availability, timeliness, or accuracy of the Service.
Indemnification
You agree to indemnify and hold harmless InstantStudio, its affiliates, employees, and the Creator from any claims, damages, liabilities, or expenses arising from your use of the Service or violation of these terms.
Limitation of Liability
InstantStudio is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service, including but not limited to damage resulting from generated images or loss of data.
Updates to Terms
We reserve the right to update these Terms and Privacy Policy at any time. Changes will be posted here, and your continued use of the Service constitutes acceptance of the updated terms.
